General Terms and Conditions of Use

1. Acceptance of Terms

By accessing the FitPlace platform and creating an account, you unreservedly accept these General Terms and Conditions of Use (T&Cs). If you do not accept these terms, you must not use the platform. These T&Cs supplement the General Terms and Conditions of Sale (GTS) and the Privacy Policy, which together form the contractual framework for the use of FitPlace.

2. Service Description

FitPlace is a platform connecting independent sports professionals ('Coaches') with establishments ('Establishments'). FitPlace acts as a technical intermediary and is in no way a party to the service contract concluded between the Coach and the Establishment. FitPlace does not control and does not guarantee the quality, legality or safety of services offered or delivered by users.

3. Registration Requirements

Registration on FitPlace is restricted to natural persons of legal age (18 years or over) or legal entities represented by a duly authorised person. By registering, you certify that you have the legal capacity to enter into a contract. You undertake to provide accurate, complete and up-to-date information, and to maintain the confidentiality of your login credentials. You are solely responsible for all activity carried out under your account.

4. User Obligations

Users undertake to use the platform in accordance with applicable laws and regulations. In particular, it is prohibited to: publish false, misleading or fraudulent information; impersonate a third party; use the platform for commercial solicitation unrelated to FitPlace services; circumvent the platform's payment mechanisms; harass, threaten or discriminate against other users; publish unlawful, defamatory, obscene content or content infringing the rights of third parties.

5. Content and Moderation

Users are responsible for the content they publish on the platform (profiles, missions, posts, messages, reviews). FitPlace reserves the right to moderate, suspend or remove any content that contravenes these T&Cs, the law or public decency. FitPlace provides a reporting mechanism accessible from the platform. Any user may report content or behaviour they consider to be in breach of the rules. Reports are reviewed by our team within a reasonable timeframe. Where content is removed, the user concerned is informed of the reason and may contest the decision by contacting support.

6. Suspension and Termination

FitPlace reserves the right to suspend or terminate a user account in the event of: breach of these T&Cs or the GTS; fraudulent or abusive behaviour; repeated reports from other users; non-payment of sums due. Suspension or termination is notified to the user by email with the reason stated. The user may contest this decision by contacting support within thirty (30) days. The user may delete their account at any time from their account settings, subject to there being no missions in progress.

7. Intellectual Property

All content on the FitPlace platform (logos, texts, images, software, databases) is protected by French and international intellectual property laws and belongs to FitPlace or is used with authorisation. Any unauthorised reproduction, representation or exploitation is prohibited. Users retain ownership of their content published on the platform but grant FitPlace a non-exclusive, free-of-charge, worldwide licence for its display and indexing in connection with the operation of the service.

8. Amendment of the T&Cs

FitPlace reserves the right to amend these T&Cs at any time. Users will be notified of any substantial amendment by email and/or notification on the platform at least thirty (30) days before it takes effect. Continued use after that date constitutes acceptance. In the event of disagreement, the user may terminate their account.

9. Applicable Law

These T&Cs are governed by French law. For any dispute relating to their interpretation or performance, the provisions set out in Article 9 of the GTS shall apply.
